MAMA MANDALA TERMS OF USE

Version 2.0. Effective September 8, 2026. Replaces the Terms of Use dated September 7, 2021.

1. Who we are

This website and everything offered through it is operated by Hagar Harpak, doing business as Mama Mandala, a sole proprietorship in Los Angeles, CA. In these terms, “we” and “us” mean Mama Mandala.

2. What these terms cover, and how you accept them

These terms cover three things:

  • Using the website at mamamandala.com. Sections 1 to 6 and 20 to 26 apply.
  • Buying and using an online course. Sections 1 to 7 and 20 to 26 apply.
  • Taking part in an in-person class, workshop, ceremony or retreat. All sections apply, and Sections 8 to 19 matter most.

Using the site means you accept these terms. Buying anything means you accept them again, by ticking the box at checkout before you pay. That tick is recorded against your order along with the version number, so you and we can both tell later which version you agreed to.

The version you accepted when you bought governs that purchase.

3. Health, movement and your own responsibility

Mama Mandala teaches movement, breath, meditation and related practices, in writing, on video and in person.

None of it is medical advice, diagnosis, treatment or psychological therapy. None of it replaces care from a qualified professional. Nobody here is your physician.

If you follow any practice we publish or teach, you do so at your own risk. Talk to your physician first if you are pregnant or postpartum, injured, recovering from surgery, managing a health condition, or taking medication that affects balance, blood pressure, heart rate or alertness.

4. The website

Your account. Where our services need an account, give us accurate information, keep your login secure, and tell us promptly if someone else uses it. You are responsible for what happens under your account.

Our content. Everything on this site and in our courses belongs to Mama Mandala or its licensors. That includes text, video, audio, images, sequences and course structure. Nothing here transfers ownership to you. Personal use is fine. Copying, republishing, reselling, or using our content to train an automated system is not.

Acceptable use. Do not try to gain unauthorized access to the site, disrupt it, scrape it at scale, or use it to send unsolicited messages to other users.

Third parties. The site uses third-party services and embeds content we do not control. Using those services is at your own risk and subject to their terms. Our privacy policy names the third parties we use.

5. Privacy

Our privacy policy at mamamandala.com/privacy-policy explains what we collect and why. It forms part of these terms.

6. Buying from us

Checkout runs on ThriveCart and card payments are processed by Stripe. We never see or store your full card number.

Prices are in US dollars and are shown before you pay. You are responsible for any tax that applies where you are.

Refunds and cancellations are governed by the refund policy at mamamandala.com/refund-policy, which forms part of these terms. Where a specific program publishes its own cancellation terms, those control for that program.

7. Online courses

You get access to the course you bought, for your own personal use, for the period described on the course page. We may update or improve course material at any time.

You may not record it, download it outside the tools we provide, republish it, resell it, or share your login.

You practice on your own, unsupervised. Work within your range, stop if something hurts, and get medical attention if it persists. Breath practices can cause lightheadedness or fainting, so never do them in water, while driving, or standing without support.

8. In-person classes, workshops, ceremonies and retreats

Depending on the program, these include yoga and movement, somatic and body-based practice, breath practice, meditation, ritual and ceremony, group discussion, and physical touch in the form of hands-on assists. Some ceremonies include herbal tea, covered in Section 11.

Sections 9 to 19 apply to anyone taking part in person.

9. ASSUMPTION OF RISK

Read this section carefully.

You understand that these activities carry risk, and you accept it. That includes:

  • Strain, sprain, tears, joint injury, and aggravation of an existing injury or condition
  • Falls, collisions, and injury from props, equipment or the floor
  • Dizziness, fainting, tingling and muscle tightening from breath practice
  • Strong emotional responses, including grief, anxiety and difficult memories surfacing
  • Reaction to anything served, including allergic reaction, as described in Section 11
  • Illness passed between people in a group
  • Risks of the venue and, for residential programs, of travel, accommodation, food and free time
  • Serious injury, permanent disability and death

You accept these risks whether they arise from the activity, from your own condition, from another participant, or from the ordinary negligence of the Released Parties named in Section 14.

10. Your health, and what you have to tell us

You confirm you are physically and mentally able to take part, and that you have checked with a physician if there is any reason for doubt.

You agree to tell the teacher, before the session starts, about anything relevant. That includes injury, illness, surgery, pregnancy, recent birth, and any medication that affects balance, blood pressure, heart rate or alertness. If it changes between sessions, tell her again.

 

The teacher is not a medical professional. Nothing offered in these programs is medical advice, diagnosis, treatment or therapy.

Pregnancy and postpartum. Prenatal and postpartum practice carries its own risks, and what is safe changes through pregnancy and recovery. If you are pregnant, recently gave birth, or are trying to conceive, get clearance from your physician or midwife before taking part, tell the teacher, and follow the modifications offered. If a ceremony includes something served, read Section 11 before deciding whether to drink it.

11. Ceremonies and anything served

Some ceremonies include herbal tea. Some ceremonies include herbal tea. The ingredients are published on that ceremony’s page. If the ingredients change before the date, we will email everyone registered. The ingredients are also stated in the room before the tea is served, and that statement is the one that applies.

Drinking it is entirely optional. Nobody is asked why they decline, and declining changes nothing about your participation.

Whether to drink it is your decision and your responsibility. You are the one who knows your body, your allergies, your medications and your health history. If you are allergic to anything on the ingredient list, do not drink it. If you are unsure whether anything on the list is right for you, do not drink it, or check with your own physician, pharmacist, midwife or other provider first. 

Nothing served is a medicine, a supplement or a treatment. No claim is made that it prevents, treats, cures or improves any condition. Nothing offered here replaces care from a licensed provider.

11.1 About who prepares it. Hagar Harpak is not a licensed physician. Preparing and sharing herbal tea in ceremony is complementary to licensed health care and is not a substitute for it, and these services are not licensed by the State of California. Her training, experience and qualifications are described on the ABOUT page. By accepting these terms you confirm you have read this paragraph.

12. Hands-on assists

Some sessions include hands-on adjustment and physical support. It is always optional. The teacher asks at the start of each session, and you can say no then or change your mind at any point during it, without explanation and without any effect on your participation.

If the participant is under 18, hands-on assists happen only with a parent or guardian present and only with their agreement on the day.

13. Emergency medical care

If you are injured or become ill and cannot give consent, you authorize us to arrange emergency treatment on your behalf. You are responsible for the cost. You confirm you have health insurance, or you accept responsibility for medical costs if you do not.

14. RELEASE AND WAIVER OF LIABILITY

Read this section carefully. It affects your legal rights.

“Released Parties” means Hagar Harpak, Mama Mandala, any assistant, co-teacher, guest teacher or volunteer working on a program, and the owner and operator of the venue where a program takes place.

In exchange for being allowed to take part, you release, waive and discharge the Released Parties from any and all claims, demands, damages and causes of action arising out of or related to your participation, including any claim arising from the negligence of the Released Parties, whether the harm is to you or to your property.

You agree not to sue the Released Parties for anything this release covers.

This release does not cover gross negligence, recklessness, willful or wanton misconduct, fraud, or any liability that California law does not allow to be released.

15. Indemnification

You agree to indemnify the Released Parties against any third-party claim arising from your own conduct during a program.

16. Photography and video

The default is no. We do not photograph or film you for public use unless we ask you on the day and you say yes. If we are documenting a session generally, you will be told before it starts and can ask to stay out of frame.

We never publish images of participants under 18.

17. Conduct

We may ask you to leave, without refund, if your conduct puts you or anyone else at risk, disrupts the program, or breaks the venue’s rules.

18. Retreats and residential programs

  • Each retreat publishes its own cancellation and payment terms on its own page. Those terms control for that retreat.
  • Travel insurance is strongly recommended, including medical and cancellation cover. We do not provide it.
  • We are not responsible for the acts or omissions of third parties, including venues, accommodation providers, transport operators, caterers and guest practitioners.
  • Passports, visas, vaccinations and entry requirements are your responsibility.
  • Medical care outside the United States can be limited, delayed or expensive. You accept that risk.
  • If we cancel a retreat for reasons beyond our control, our liability is limited to the fees you paid us.

19. Who these terms bind

The person taking part must accept these terms in their own name before the session, whether or not they paid.

If you register someone else, you are responsible for making sure they accept these terms before they attend. We will send them a link.

A person under 18 may take part only if a parent or legal guardian registers them, names them at registration, and accepts these terms on their behalf. A minor’s own acceptance is not valid. A parent or guardian accepting these terms does so for themselves and for the participant, and confirms they have the legal authority to do so.

20. Disclaimer and limitation of liability

The website and its content are provided as is and as available. To the fullest extent the law allows we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted or error free.

To the fullest extent the law allows, our total liability arising from your use of this site or any online course is limited to the greater of what you paid us in the 12 months before the claim, or one hundred dollars. For in-person participation, Section 14 governs. Nothing here limits liability that California law does not permit to be limited.

21. DISPUTES, ARBITRATION AND CLASS ACTION WAIVER

Read this section carefully. It affects how any dispute between us gets decided.

21.1 Individual arbitration. Any dispute arising out of or relating to these terms, the website, a course, or your participation in a program will be resolved by binding individual arbitration, administered by JAMS under its Streamlined Arbitration Rules and its Consumer Minimum Standards, before a single arbitrator. Arbitration is less formal than court. The arbitrator can award the same individual relief a court could.

21.2 Where and how. The seat of arbitration is Los Angeles County, California. You may take part by phone or video and you are not required to travel.

21.3 Fees. You pay no more than the consumer filing fee set by the applicable JAMS consumer standards. Mama Mandala pays the remaining arbitration fees and the arbitrator’s costs. Each side pays its own attorneys’ fees unless the law provides otherwise.

21.4 Small claims. Either of us may bring an individual claim in small claims court instead, if it qualifies.

21.5 Class action waiver. Claims are brought in your individual capacity only. Neither of us may bring a class, collective, consolidated or representative action, and the arbitrator may not consolidate claims.

21.6 Relief the arbitrator may award. Subject to Section 21.9, the arbitrator may award any individual relief a court could award. If California law entitles you to seek public injunctive relief, you may seek it in this arbitration and the arbitrator may award it. Nothing in this Section 21 waives that right in any forum.

21.7 How to opt out. You may opt out of this arbitration agreement by emailing mama@mamamandala.com within 30 days of your first purchase, giving your name and the program. Opting out does not affect anything else in these terms and does not affect your participation.

21.8 If part of this fails. If Section 21.5 is found unenforceable as to a particular claim, that claim proceeds in court and the rest of Section 21 still applies to every other claim.

21.9 Remedy for private claims. Except where the law provides otherwise, money damages are the sole remedy for any claim brought for your own benefit. Nothing in these terms entitles you to an order suspending, restraining or otherwise interfering with the operation of Mama Mandala’s programs, website or business.

22. Termination

We may suspend or end your access to the site or to a course at any time. Provisions that by their nature survive termination do survive, including ownership, disclaimers, the release, indemnity, limitation of liability and disputes.

23. Changes to these terms

We may revise these terms. The version number and effective date at the top tell you which version is current. Material changes are posted here and, where they affect existing customers, sent by email before they take effect.

Changing these terms does not change the version you accepted for a purchase you already made.

24. General

If any part of these terms is unenforceable, the rest stands. These terms, the refund policy, the privacy policy and any terms published for a specific program are the whole agreement between us. California law governs, without regard to its conflict of law rules.

25. Acknowledgment

By accepting these terms at checkout you confirm that you have read them, that you understand you are giving up legal rights including the right to sue for negligence and the right to a jury trial, that you are doing so freely, and that you are 18 or older or a parent or guardian registering a minor.
